You are reading the English-language version of the BDMI privacy policy. Among the different translated versions, the text of the Spanish version will always prevail over the other versions in case of different interpretations and/or discrepancies.
The following is a summary of the most important things you should know in relation to your relationship with our Defaulting Tenants Database known as Base de Datos de Morosidad Inmobiliaria, S.L.U. (“BDMI“):
I. As an owner or private advertiser
At BDMI, we are responsible for processing the personal data that you, or the agency acting on your behalf, where applicable, provide us with and we process it in order to provide you with the services you request from us (directly or through said agency). As soon as you request a service from us, or an agency does so on your behalf, this request becomes the contractual relationship which is the legal basis for processing.
II. As a professional agency or representative
BDMI is responsible for processing the personal data you provide us with and we process this data in order to provide you with the services you request from us on the basis of the contract signed with the entity you represent, the legal basis for this processing being the legitimate interest of BDMI.
In both cases, your data may be shared with BDMI service providers who must access it in order to provide you with the contracted service.
Notwithstanding the aforementioned details, you may at any time access, rectify or delete your data, as well as exercise other rights, as explained below.
We recommend that you read this entire privacy policy in order to know, in detail, what data we use and how long we need to keep it for.

1. Data controller: who is responsible for processing your data?
Base de Datos de Morosidad Inmobiliaria, S.L.U., a company with registered office at Plaza de las Cortes 2, 5ª 28014 Madrid, e-mail hola@datosmorosos.com, and holder of Tax Identification Number (NIF): B-88415104, “BDMI” is responsible for the processing of the personal data that you submit through our website and its subdomains (hereinafter, the “Website“).
In the following clauses we provide you with information about your rights and the use we will make of the personal data you provide to BDMI in the various forms on the Website, in accordance with the General Data Protection Regulation (“GDPR“).

2. Purpose of the processing: what can we do with your data?
a) We process your personal data in order to provide you with the services you have requested. In particular, we process data for the purpose of managing the access that you, as the owner of the property, or on behalf of the owner (in the case of agencies), request to our database, or to manage the registration of your tenant (or that of the owner you represent, in the case of agencies) in our negative equity solvency file.
b) In the event that you make a claim or enquiry to us, we will process your data for the purpose of dealing with your claim or enquiry.
c) If you are a representative or contact person of a professional client, we process your personal data to maintain contact with the entities you represent.
d) If you have contracted a payment service, we will also process your data to manage any claims you may owe us for our services.
3. Legal basis/legitimacy: why can we process it?
The legal bases that allow us to process your data for each of the purposes indicated in section 2 above are:
- Contractual relationship: this is the one that applies when you request a service from us as indicated in section 2.a above, even if it is free of charge.
- Legitimate interest: to deal with the queries and claims you raise with us (section 2.b above) and to manage the recovery of amounts owed (2.d above). Moreover, if you are the representative or contact person of a professional client, we have a legitimate interest in remaining in contact with the entity you represent and we provide our services to (section 2.c above).
4. Recipients: to whom can we disclose your data?
BDMI’s service providers in the systems and technology or administrative management sectors may also have access to your data in connection with the provision of services that these third parties provide to BDMI.
Other than in these cases, we will not disclose your personal data to third parties except where there is a legal obligation to do so.
5. Communication of data: where can we send it?
We will not make international transfers of your personal data for any of the above purposes.
6. Data retention period: how long will we process it for?
BDMI will store such personal data for a period of five (5) years, and may subsequently keep the data blocked for the periods of time resulting from the prescription of legal actions related to this processing.
7. Rights of data subjects
We hereby inform you that you can exercise the following rights:
- The right to access your personal data to know which ones are subject to processing and the data processing operations carried out with it;
- The right to rectify any inaccurate personal data;
- The right to cancel your personal data, whenever this is possible (for example, by a legal order);
- The right to request the restriction of your personal data processing when the accuracy, legality or need for the data processing is in doubt, in such case, we can keep it to file or defend any claims.
- The right to oppose processing of your personal data, when the legal basis that authorises us to process it in our legitimate interest allows this. idealista will stop processing your data unless it has a legitimate interest, or it is necessary to defend claims.
- The right to the portability of your data, when the legal basis that authorises us to process it is the existence of a contractual relationship or your consent has been granted.
- The right to revoke the consent granted to BDMI.
You may exercise your rights at any time and free of charge by sending an email to hola@datosmorosos.com indicating the right you wish to exercise and your identification details.
We also inform you that you are entitled to submit a claim to the Spanish Data Protection Agency if you consider an infringement has been committed of the data protection laws when processing your personal data.
8. Confidentiality and security
At BDMI, we make all reasonable efforts to maintain the confidentiality of personal information processed through the Website. We maintain strict levels of security to protect the personal data we process against accidental loss and against unauthorised access, processing or disclosure, taking into account the state of technology and the nature and risks to which the data is exposed. However, we cannot be responsible for your use of the data (including your username and password) that you use on BDMI outside the Website.
