1. What does this service consist of?

We make an online space available to registered users of our website, located under the domain www.idealista.com and its respective sub-domains or mobile applications, (hereinafter referred to as the “Website and Apps“), owned by Idealista, S.A.U., (hereinafter referred to as “idealista“), so that certain advertisers, (hereinafter referred to as the “Advertiser(s)“), can offer bookings of rooms and homes for rent, (hereinafter referred to as the “Property(ies)“) and so that tenants or occupants, (hereinafter referred to as the “Tenant(s)“), can make such bookings for medium or long term stays, (minimum 1 month), (hereinafter referred to as the “OLB Service“). In all cases, rental for tourist or holiday use is excluded.

The ROL Service is exclusively intended for clients who directly manage the Properties they advertise, such as agencies and real estate agents. For clarification purposes, idealista is not the owner, manager, real estate agent nor does it own, sell, resell, furnish, rent, sublet, manage or control the Properties in any way.

2. Access and acceptance of the OLB Terms and Conditions

Your access to the OLB Service implies that you have read, understand and agree that these terms and conditions, (hereinafter referred to as the “OLB Terms and Conditions“), and idealista’s general terms and conditions, (hereinafter referred to as “idealista’s General Terms and Conditions“), are binding with no exception. These OLB Terms and Conditions supplement and form an integral part of idealista’s General Terms and Conditions. For any aspects not specified in the OLB Terms and Conditions, idealista’s General Terms and Conditions shall be applicable. In the event of any discrepancy between both sets of terms and conditions, these OLB Terms and Conditions shall prevail for the OLB Service.

idealista reserves the right to extend, modify, replace or cancel the OLB Service and these OLB Terms and Conditions at any time. In any case, we will do our best to notify you of any significant modification that the OLB Terms and Conditions may undergo with sufficient prior notice. In particular, if you are registered on the Website and Apps, we will notify you by sending an email to the address you have provided to us. We will also update the “date of last update” at the top of these OLB Terms and Conditions. In any case, we advise you to review these OLB Terms and Conditions every time you use the OLB Service so that you are aware of any changes we may have made. To the fullest extent permitted by law, idealista shall not be held liable for any changes made to the OLB Terms and Conditions or the OLB Service.

If you access the Website and Apps and use the OLB Service after any changes have been made to the OLB Terms and Conditions, you expressly agree to accept the new OLB Terms and Conditions.

3. How does the OLB Service work?

idealista provides Advertisers with an online space where they can offer bookings for their Properties, including all the information related to these Properties, such as the rental amount (itemising, when applicable, the services or utilities included, as well as the deposit or guarantee), availability in the calendar, property rules, cancellation policy, expenses and type of contract, among others. By including this information, Advertisers guarantee that the information is truthful, accurate and up to date.

Listings with the option for online booking will be displayed in a preferred position in the search results. If you want to know the main parameters we use to sort the listings published on the Website and Apps, you can check here how we order the results.

idealista merely provides the means for Advertisers that offer a property for rental booking to contact those who are looking for such booking (Tenants). idealista does not own, control, offer or manage any published listing and is not a party to or involved in any contracts entered into directly between the Advertisers (or owners on whose behalf they act) and Tenants. idealista merely provides a technological platform for the management of potential bookings, including the management of the payment of such bookings through an authorised payment service provider on behalf of the Advertiser and Tenant.

Prospective Tenants may use the OLB Service to formalise the booking of a Property they are interested in through the Website and Apps. The Tenant must submit a booking request, (hereinafter referred to as the “Booking Request“), through the Website and Apps that must be accepted or rejected by the Advertiser within a maximum of 24 hours, excluding Saturdays and Sundays. Advertisers shall be free to accept or reject any Booking Request they receive within such period.

If the Advertiser accepts the Booking Request, the requested dates will be blocked in the Advertiser’s calendar, the charge will be made through the payment method chosen by the Tenant and the booking will be finally confirmed, (hereinafter referred to as the “Booking“), in accordance with these OLB Terms and Conditions, idealista’s General Terms and Conditions, the booking conditions and the Cancellation Policy, as defined below, (hereinafter referred to as the “Booking Conditions“).

If the Advertiser refuses the request or the deadline expires without being accepted, the Booking Request will be cancelled, at no cost for the Tenant.

The Tenant must include a valid payment method in the Booking Request for the amount of the Booking and Platform Fee, (as defined in section 5.2 below). By submitting a Booking Request with their payment details, the Tenant expressly authorizes idealista and, where applicable, the authorized payment service provider, to make the corresponding charge only if the Advertiser accepts the Booking Request. At that time, the corresponding amount will be charged. Until then, no actual charge will be made, although the payment method may be validated.

Through its payment service provider, idealista will retain the amount of the Booking, equivalent to the first month’s rent payable for the rental of the Property and the Platform Fee. The amount corresponding to the first month’s rent will not be released to the Advertiser until 48 hours have elapsed counted from the Effective Start of the Booking. If, during this period, the Tenant notifies idealista of any anomaly or irregularity detected in the Property, idealista will retain the aforementioned amount until the incident is resolved, in accordance with the provisions in section 6 below.

The “Effective Start of the Booking” shall be understood as the date on which the Tenant physically accesses the Property (check-in), which will by default be the date established in the Booking confirmation (the “Booking Start Date”). However, the Tenant may inform both idealista and the Advertiser of a later move-in date, with a minimum notice of 5 calendar days prior to the Booking Start Date, provided that such move-in occurs within a maximum of 30 calendar days from said date. In such case, the newly communicated date will be considered the Effective Start of the Booking for all purposes.

In the event that the Tenant wishes to cancel the Booking, the provisions of the cancellation policy chosen by the Advertiser, (hereinafter referred to the “Cancellation Policy“), shall be applicable. This Cancellation Policy must always be included in the listing of each Property. Therefore, at the time of making the Booking Request, it shall be deemed to be accepted by the Tenant and shall form an integral part of the Booking Conditions.

Advertisers and Tenants will be provided with access to the idealista chat to communicate and interact with each other in order to settle any doubts and provide further information about the listed Properties and Bookings. The chat may not be used for any other purpose or to arrange bookings outside the platform. idealista reserves the right to supervise its use in order to ensure that it complies with the OLB Terms and Conditions, idealista’s General Terms and Conditions and is always in accordance with the provisions for data processing referred to in section 10 below.

In the event that the Tenant is a consumer, it is expressly stated that, by accepting these ROL Conditions, the right of withdrawal from the OLB Service is waived, in accordance with the provisions of Article 103.m) of Royal Legislative Decree 1/2007, of November 16, which approves the Revised Text of the General Law for the Protection of Consumers and Users.

4. Conditions applicable to Advertisers

As an Advertiser, idealista provides you with the use of a technological platform to offer potential Tenants the rental booking of your Property. You can decide at all times the amount of the rent, (itemising, when applicable, the services or utilities included, as well as the deposit or guarantee), availability in the calendar, Cancellation Policy of the Booking, property rules, expenses and type of contract, among others. By including this information in the listing, you guarantee that the information is truthful, accurate and up to date, and comply with the law in force.

4.1. Obligations of the Advertiser

In particular, by using the OLB Service, you agree to comply with the following conditions:

  • You must include all the necessary information about the property and the rental you plan to carry out, such as the real and exact address of the Property, including its cadastral reference, the amount of the monthly rent, the Cancellation Policy, availability in the calendar, minimum stay, services included, if applicable, type of contract, utilities, expenses, deposit and guarantee, among others.
  • You must include complete and accurate information in your listing. In this respect, you acknowledge that you are solely responsible for the information included in the listing and you are the only party responsible for keeping the content of the listing up to date at all times.
  • You must not include in the description field of the listing any repetitive information that already appears in other specific fields of the publication, to avoid possible misunderstandings or inconsistencies. If any repetitive or contradictory information is detected between the description and other fields, you will be notified to correct it. In any case, you acknowledge that in the event of a contradiction, the information provided in the specific fields will prevail over that in the description of the listing.
  • You must comply with the publication rules set out in Section 6 of idealista’s General Terms and Conditions, as well as with the specific requirements of the OLB Service. In particular, for a listing to be published as part of the OLB Service, it must include at least: (i) three photographs of the room being offered; and (ii) at least one photograph of each of the shared spaces listed as available in the ad (such as bathroom, kitchen, living room, etc.). Additionally, idealista may inform you of other requirements necessary to optimize the listing, and you agree to comply with them to the extent reasonably possible.
  • You acknowledge and accept that each listing may refer to only one Property. Each listing must exclusively correspond to an individual housing unit. Failure to comply with this condition may result in the deactivation of the listing or the OLB Service itself.
  • You agree to review and keep the calendar duly updated at all times and to correctly mark the occupied and available periods. If you use an external platform to synchronise the calendar, you acknowledge that you are the sole party responsible for its correct execution. idealista accepts no responsibility for the content resulting from the calendar synchronisations you may make.
  • You undertake to keep your details complete and up to date at all times, amending them as soon as possible, if need be.
  • You agree not to delete and successively publish identical listings for the same Property, especially to take advantage of potential promotions intended for newly published listings. If this practice is detected, idealista may deny the requested promotion and apply the corresponding penalties in the ROL Service.
  • By publishing a listing, you acknowledge that you are the sole owner of the Property (or are duly authorized for its publication and exploitation), and you will assume sole responsibility for any liability or damage that may arise. If you are a legal entity, you acknowledge that you are authorized to accept these ROL Conditions on behalf of the entity you represent and bind it to all obligations arising from these ROL Conditions and the Reservation Conditions.
  • You will be allowed a period of 24 hours, (counted in working days, i.e. Monday to Friday, excluding Saturdays and Sundays), to accept the Booking Request sent by the Tenant, otherwise the Booking Request will be automatically cancelled. You may receive several Booking Requests for a Property on the same date; however, once a Booking Request is accepted, the others will be automatically cancelled and the calendar will be blocked on those dates to avoid overbooking.
  • Once a Reservation Request is accepted, you agree to contact the Tenant within 24 hours of such acceptance to provide information reasonably relevant to the start of their stay. idealista may apply any measures it deems appropriate against the Advertiser in the event of no interaction with the Tenant within 24 hours of accepting the Reservation Request.
  • If you accept a Booking Request, you agree to enter into a rental contract directly with the Tenant and you are solely responsible for complying with it in accordance with the Booking Conditions. The rental contract will be entered into exclusively with the Tenant, you therefore acknowledge that idealista will not be a party to such a contract nor will idealista be responsible for its fulfilment.
  • You undertake to observe these OLB Terms and Conditions, idealista’s General Terms and Conditions, the Booking Conditions, the law in force at all times, morality, good customs and public order. You expressly acknowledge that you are solely responsible for understanding and complying with all applicable laws and that you have obtained all the authorisations, licences, permits, contracts, etc. necessary to act as an Advertiser including, by way of example only, the Rental Registration Number (Número de Registro de Alquiler, NRA in Spanish), required for seasonal or tourist-use rentals on digital platforms..
  • You acknowledge that you are solely responsible for, when applicable, communicating or registering the Tenants’ details with the relevant authorities, in accordance with the applicable regulations.
  • You acknowledge and agree that, in all cases, you will hold idealista harmless for any claim that may be directly or indirectly filed related to providing the OLB Service.
  • You authorise idealista to keep the Tenant’s payment blocked until 48 hours have elapsed after the Tenant has entered the Property, object of the Booking. In the event that the Tenant reports any anomaly or irregularity in the aforementioned Property, you authorise idealista to retain payment and proceed in accordance with the provisions in section 6 of these OLB Terms and Conditions.
  • You must provide all the necessary information or instructions well in advance for the Tenant to enter the Premises.
  • You expressly authorise idealista to show the exact address of your Property to the Tenant once the Booking has been confirmed.
  • Once a Reservation Request is received, you may not request from the Tenant, either through the rental agreement or by any other means, a rent or other amounts different from or higher than those published in the listing. Additionally, you may not request any payment for items not expressly included in the listing, unless you have the Tenant’s express consent.
  • You guarantee fulfilment of the Booking in accordance with the Booking Conditions. You undertake to notify idealista and the Tenant if, due to force majeure or other circumstances, you are unable to complete the Booking, in accordance with section 8.3. below.
  • You agree not to redirect potential Tenants to external booking methods different from and unrelated to idealista’s Web and Apps. In case of non-compliance, you will hold idealista harmless against any claim from the potential Tenant, the Tenant, or third parties regarding the relevant booking, and you acknowledge that idealista reserves the right to (i) immediately deactivate the ROL Service; or (ii) apply penalties within the ROL Service.

4.2. Rent Calculation Method

Although the minimum stay allowed for the OLB Service is 1 month, the Advertiser can determine how to charge the rent according to the “type of contract” that defines the calculation method, and can choose between: daily, biweekly, or monthly. If the Tenant books for a period exceeding the minimum month, the charge will be made according to the option chosen by the Advertiser:

  • Daily calculation: the charge will be for the days actually occupied.
  • Biweekly calculation: the charge will be for fifteen-day periods, including any additional fraction of time proportionally.
  • Monthly calculation: the charge will be for full months, regardless of whether the Tenant has occupied the Property for only a fraction of the second month.

The calculation method (also referred to as “type of contract”) and the corresponding rent will be clearly specified in the Property listing.

4.3. Request for Documentation from the Tenant

As an Advertiser, you may request certain information or documentation from the Tenant before accepting a Reservation Request, in order to assess their suitability for renting the Property. The decision on which documents to request, and whether their submission is mandatory or optional, rests solely with the Advertiser.
The Tenant may be asked to provide the following evidence:

  • Proof of identity (DNI, NIE, or passport).
  • Proof of income (pay slips or bank statements of the Tenant or, if applicable, of a guarantor).
  • Proof of occupancy (study enrollment, tax registration, or current employment contract).

Each Advertiser may select which of these documents will be required (optional or mandatory) to formalize a Reservation Request. The use, assessment, and any decision based on the requested documentation are the sole responsibility of the Advertiser, who must ensure compliance with applicable law.

Documents shared by the Tenant may be viewed and downloaded exclusively for 24 hours from the submission of the Reservation Request, by both the Tenant and the Advertiser. If the Reservation Request is accepted, the Advertiser may continue accessing these documents up to 48 hours after the Effective Start of the Reservation.

The request and submission of documentation must be carried out exclusively through the system provided for this purpose by idealista (use of other methods is not enforceable against idealista), and the Tenant may freely decide whether or not to provide the requested documentation. Under no circumstances may acceptance of the Reservation be conditioned on the use of channels external to idealista, nor may payments or submission of documentation outside the platform be required. If such practices are detected, idealista may take corrective measures it deems appropriate against the Advertiser.

Documents provided by the Tenant will be retained by idealista for a maximum of 60 calendar days from the date of rejection of the Reservation Request or from the Effective Start of the Reservation, as applicable.

For clarification purposes, idealista does not intervene, use, or supervise the content of such documentation and will not be responsible for any decision made by the Advertiser based on it. However, idealista may use this information when strictly necessary to manage and defend payment reversals (chargebacks), also in the interest and on behalf of the Advertiser.

After this period, the documents will be permanently and irreversibly deleted.

4.4. OLB Fee

A fee will be charged by idealista for each Booking that will be payable by the Advertiser, (hereinafter referred to as the “OLB Fee“). Unless expressly stipulated otherwise, the OLB Fee will consist of payment to idealista of an amount equivalent to 5% of the total amount of the stay subject to a booking in a certain Property, (excluding the Platform Fee), with a minimum of 20% and a maximum of 50% of the rent applicable to a monthly payment, excluding taxes. idealista reserves the right to modify this OLB Fee at any time by notifying the Advertiser with sufficient prior notice. The OLB Fee will be automatically payable upon confirmation of a Booking Request and will be deducted from the amount paid by the Tenant for such Booking, (minus the Platform Fee).

In the event that the Advertiser makes a counteroffer on a previously received Booking Request, the OLB Fee applicable to the resulting new Booking may not be less than 75% of the OLB Fee that would have applied to the original Booking, calculated in accordance with the criteria established in this section. For these purposes, “original Booking” shall mean the one arising from the initial Booking Request sent by the Tenant before the Advertiser submitted the counteroffer. In no case shall the OLB Fee resulting from the counteroffer exceed the full monthly rent applicable to the Property subject to the countered Booking.

4.5. Payment management

As an Advertiser, you authorise idealista to retain the Booking fee paid by the Tenant in an escrow account managed by an authorised payment service provider.

Once 48 hours have elapsed counted from the Effective Start of the Booking without the Tenant having notified any incident, in accordance with section 6 below, the funds retained after deduction of the OLB Fee and the Platform Fee will be sent by SEPA bank transfer to the bank account specified by the Advertiser.

Before publishing a Property, in order to receive the funds corresponding to the Booking, all Advertisers must specify a valid SEPA bank account number and must accept any costs that may be incurred for such transfer.

Under no circumstances does idealista provide a payment processing service and is not responsible for the time required to process the transfer.

4.6. KYC verification

In order to transfer funds, Advertisers will be subject to the regulatory procedures applied by the authorised payment service provider, such as identity verification and other “Know your Customer” (KYC) requirements.

For the purpose of identity verification, the authorised payment service provider may request the following documents:

  • If you are a natural person: Full name, identity document, country of birth or residence, proof of address, telephone number, e-mail address, tax ID, bank account details, a bank statement.
  • If you are a legal person: Company name, country, company structure, tax identification code, registered office or tax domicile, bank account details, a bank statement, identification and information about the beneficial owner(s).

The payment service provider may request additional information if necessary.

Please note that if you do not send the requested documents or the transaction is considered suspicious, no payment will be made and such payment will be suspended until the relevant verifications have been conducted.

Furthermore, idealista reserves the right to implement any additional anti-fraud measures it deems appropriate or necessary from time to time.

5. Conditions applicable to the Tenants

idealista provides users with an online space where they can book a property in a simple and straightforward manner, creating a secure environment for Advertisers and potential Tenants.

5.1 What do you need to do to book a property?

You will be able to search for properties on the Website and Apps, filtering according to your desired specifications, such as city, rental price and dates, among others. The duration of the rental must be at least 1 month and the Advertiser may specify a longer minimum period. Tourist or holiday rentals are expressly excluded.

If you are interested in a specific Property, you can send a Booking Request to the Advertiser by registering and creating a Tenant Profile that will be shared with the Advertiser. You must include truthful, accurate and updated information and, where necessary, the evidence requested by the Advertiser, pursuant to section 4.3. above, in your Tenant Profile and the Booking Request. Please note that you are solely responsible for any inaccuracies in your profile data or the information provided in the Booking Request.

idealista does not intervene in any way in the selection of the Tenant, it is the Advertiser that will accept or reject a Booking Request.

When submitting the Booking Request you must add a valid payment method with available funds to secure the Booking Request. You will not be charged until the Booking Request has been accepted by the Advertiser. You are solely responsible for the legitimacy of the payment method selected and that it is valid, authorised and there are sufficient funds to complete the transaction. If you include a payment method with insufficient funds, the Booking Request will be cancelled.

By submitting a Booking Request, you acknowledge that you have been duly informed of the Booking Conditions and you have accepted them, which include these OLB Terms and Conditions, idealista’s General Terms and Conditions, the property rules and Cancellation Policy. You further acknowledge that idealista has made this information available to you in an accessible and complete manner.

You may submit multiple Booking Requests for the same dates; however, the first Booking Request accepted by an Advertiser will mean the other Booking Requests will be automatically cancelled.

By making a Booking, you agree to pay all the items specified by the Advertiser, such as the rent, deposit (if applicable) and any other necessary expenses, (cleaning costs, utilities, etc.), and taxes.

For the avoidance of doubts, you agree to pay the rent in accordance with the type of contract chosen by the Advertiser, either daily, fortnightly or monthly, as described in section 4.2 above. This information will be clearly specified at the time you make the Booking Request.

The first monthly rental payment and the Platform Fee is payable to idealista through our authorised payment service provider. The payment of the following monthly payments and other applicable items will be managed directly between the Tenant and the Advertiser, in accordance with the contract that has been entered into between them.

You undertake not to redirect Advertisers to booking methods outside the idealista Website and Apps. In the event of non-compliance with this condition, idealista reserves the right to immediately prohibit you from using the OLB Service.

The Booking will be subject to the Cancellation Policy selected by the Advertiser in each case, so ensure that you read it carefully before submitting a Booking Request for a specific Property.

5.2 Platform Fee

The Tenant accepts payment of a fee for each Booking made, (hereinafter referred to as the “idealista Platform Fee or Service Fee“), which consists of a percentage of 20% of the first month’s rent payable for a Property, with a minimum of €100 and a maximum of €250 (VAT included). We reserve the right to change this percentage at any time; in any case, you will be informed of the exact amount at the time you submit a new Booking Request.

For the avoidance of doubts, the Platform Fee covers the costs incurred for the OLB Service provided on our platform under secure conditions and where we provide appropriate support by a dedicated customer service team. Therefore, the Platform Fee is non-refundable in the event of cancellation by the Tenant, in accordance with the provisions in section 8.2 below.

6. The OLB Service Guarantee

It is the Advertiser’s responsibility to ensure that the Property booked by the Tenant meets the expected and reasonable conditions in terms of living conditions and that the characteristics and price published in the listing are in line with the real situation.

Through its payment service provider, idealista will retain the booking amount paid by the Tenant, which will not be provided to the Advertiser until 48 hours have elapsed after the Effective Start of the Bookingg. In other words, if the scheduled start date for the Booking is, for example, 1 August, idealista will retain this amount until 11:59 pm on 3 August.

If, during the indicated 48 hours, an issue arises related to the Property subject to the Reservation, the Tenant must inform the Advertiser as soon as they become aware, by contacting them. If the Tenant wishes to cancel their Reservation due to this issue, they must request it directly through the number 917 012 031 or via their idealista profile within 48 hours of the Effective Start of the Reservation, entering “Room Reservations” and selecting “Cancel Reservation.” The Tenant then has 48 hours to send an email to reservas@idealista.com, indicating the Reservation code and attaching any relevant evidence, such as photos or videos of anomalies or irregularities detected in the Property. idealista will then begin a process to analyse the circumstances of the case, comparing the information published in the listing posted by the Advertiser and the information/documents provided by the Tenant and, if applicable, the Advertiser.

During this process, idealista may share with both parties the information strictly necessary to resolve the incident, including, where applicable, images or other evidence provided by either party. At all times, appropriate measures will be taken to protect the privacy of the affected users, ensuring that only the information essential to the resolution of the incident is shared.

idealista may resolve each case as follows:

  • In favour of the Tenant, in such case it will return the amount of the Booking, along with the Platform Fee.
  • In favour of the Advertiser, in such case it will send the payment of the Booking to the Advertiser, (minus the OLB Fee), and will charge the Platform Fee.

idealista will only reimburse the amounts paid by the Tenant when there is sufficient evidence of a significant irregularity in the Property subject to the Booking, such as substantial changes that differ from the description in the listing, unavailability of the Property for use during the term agreed in the Booking or non-compliance with basic hygiene, health or living conditions in the property. These conditions include but are not limited to the following: a different Property being provided, presence of large-scale infestation (pests), structural problems affecting safety or lack of access to essential services, such as water and electricity.

In the case of both significant irregularities and minor deficiencies, (e.g. insufficient cleanliness, missing or defective furnishings, etc.), the Advertiser undertakes to seek alternatives for the Tenant, ensuring that the alternative Property complies with the information published in the listing. idealista reserves the right to immediately cancel the listing and penalise or limit the OLB Service for the Advertiser if any significant or minor anomalies or irregularities in the property have been caused by the Advertiser and the Advertiser does not adopt appropriate measures to remedy them. The Advertiser shall also bear all the costs incurred due to this situation and idealista shall be held fully harmless for such reason.

In the event that the Tenant abandons the Property during the first 48 hours of his/her stay and cancels the Booking without providing sufficient evidence or allowing idealista to assess the situation in accordance with the Booking Conditions, the amount paid for the Booking will be transferred to the Advertiser. Likewise, if the anomalies or irregularities are not clear, are not sufficiently proven or are considered minor, idealista will pay the relevant amount to the Advertiser.

For the avoidance of doubts, no Booking amount will be refunded if, after the expiry of the applicable Cancellation Policy terms, the Property is not to the Tenant’s taste or is not in accordance with the Tenant’s beliefs or ideology, (including cohabitation with persons of the opposite gender); if the Property is not clean, is in a more hazardous neighbourhood or complaints are made about noise. Nor will any amount be refunded if the Tenant has difficulty arriving at the Property on the scheduled date or is unable to stay in the Property for the agreed period due to a change of plans, travel delays, minor illness or any other reason beyond the control of the Advertiser or idealista.

The Tenant and the Advertiser expressly acknowledge and agree to be subject to idealista’s criteria for managing these incidents. In the event of a disagreement with the final decision, both parties may directly settle the differences between them, undertaking that idealista will not be involved in the dispute.

7. Payment methods

All payments for the OLB Service will be handled by the third-party payment service provider Adyen, N.V., a company registered in the Dutch Chamber of Commerce with number 34259528 and with address at Simon Carmiggeltstraat 6-50, 1011 DJ in Amsterdam, The Netherlands, which is assigned to process the payments made and to store information relating to credit cards, debit cards and any other payment methods offered for the OLB Service. In order to use the service of the payment service provider, the Advertiser and the Tenant must agree to its terms and conditions.

In the event that the Tenant provides a credit card, debit card or other payment method that is suspected to belong to a third party or is potentially fraudulent, the payment service provider, through idealista, may request additional evidence to confirm the ownership or legitimacy of the card or payment method.

The amount paid for the Booking will be held in an escrow account managed by idealista through the payment service provider. The Tenant is solely responsible for providing accurate information related to the credit cards, debit cards or any other payment method offered for the OLB Service. Under no circumstances will idealista be held liable with respect to the information provided by the Tenant, in accordance with the applicable regulations.

The right to use the payment service provider and make payments shall be exclusively restricted to the OLB Service. Under no circumstances may the Tenant use the OLB Service for other types of transactions nor may the Tenant allow third parties to use the OLB Service on the Tenant’s behalf.

The prices specified for the OLB Service are expressed in Euros (EUR). Any transaction involving currency conversion will be subject to currency exchange charges, which will be the sole responsibility of the Tenant. These additional charges may vary depending on the policies of the payment service provider or bank involved in the transaction. It is the Tenant’s responsibility to be aware of any possible currency exchange charges before proceeding with the Booking and related payments.

The Advertiser shall be subject to the regulatory procedures determined by the Payment Service Provider, including identity verification and other requirements of the Know Your Customer (KYC) procedure. The Advertiser will receive details of the required information and documents to be provided to the payment service provider. The Advertiser accepts the sole responsibility that all the information provided is truthful, accurate and reliable in compliance with the stipulated requirements.

In the event of receiving a payment reversal (Chargeback) from the Tenant, the full charge will be assumed by the Advertiser. idealista will collect the amounts owed (Reservation amount, including the ROL Commission) from the Advertiser, either by deducting other retained funds or by generating a debt in their account. idealista will manage the Chargeback process and may request relevant information and documentation from the Advertiser, including that previously provided as part of the Reservation Request. If the Chargeback is ultimately won, the corresponding amount will be refunded to the Advertiser. idealista reserves the right to charge an additional fee to the Advertiser for managing and representing chargebacks if they occur frequently.

8. Cancellation Policy and modification of the Booking

8.1 Modification of the Booking

Bookings made using the OLB Service cannot be unilaterally modified. Only in the case of an agreement being reached between the Advertiser and the Tenant will modifications to a Booking be allowed and both parties will be obliged to immediately notify idealista. In the event that the agreed modifications are not notified, idealista will act in accordance with the Booking and the Booking Conditions, without accepting any liability.

8.2 Cancellation Policy

Cancellation of a Booking shall be subject to the Cancellation Policy chosen by the Advertiser in each case, which must be published in the listing and will form an integral part of the Booking Conditions.

The Cancellation Policies supported by the OLB Service are as follows:

  1. Strict:
  • The Tenant may cancel the Booking up to 60 days before the Booking Start Date, receiving a 100% refund of the amount of the Booking.
  • The Tenant may cancel the Booking up to 30 days before the Booking Start Date, receiving a refund of 50% of the amount of the Booking.
  1. Standard:
  • The Tenant may cancel the Booking up to 30 days before the Booking Start Date, receiving a 100% refund of the amount of the Booking.
  • The Tenant may cancel the Booking up to 15 days before the Booking Start Date, receiving a refund of 50% of the amount of the Booking.
  1. Flexible:
  • The Tenant may cancel the Booking up to 15 days before the Booking Start Date, receiving a 100% refund of the Booking amount.
  • The Tenant may cancel the Booking up to 7 days before the Booking Start Date, receiving a refund of 50% of the Booking amount.
  1. Non-refundable: in this case, no refund will be made in the event that the Tenant cancels the Booking.

The Tenant shall not be entitled to any refund when cancellation is requested after the time limits set out in each of the aforementioned Cancellation Policies.

For clarification purposes, if the Tenant does not show up at the Property within 48 hours of the Effective Start of the Booking, it will be considered a no-show. This situation will have the same consequences as a late cancellation, and the amount paid will be transferred to the Advertiser, with the Tenant having no right to a refund.

Under no circumstances will the Platform Fee, (or idealista Service), be refunded to the Tenant, regardless of the Cancellation Policy selected by the Advertiser.

Notwithstanding the provisions in this section of the Cancellation Policy, idealista will grant the Tenant a 24-hour grace period from the time the Booking Request is accepted by the Advertiser, during which time the Tenant may cancel the Booking with a full refund of the amount paid, minus the Platform Fee; this is regardless of the Cancellation Policy chosen by the Advertiser.

Likewise, the provisions in section 8.3 below, regarding the possibility of cancellation in the event of force majeure, shall be applicable to the Tenant, with the appropriate adaptations. For the avoidance of doubts, idealista reserves the right to assess the evidence submitted to verify whether or not the cancellation by the Tenant is due to force majeure. In this regard:

  • The Tenant will have a maximum period of 48 hours from the cancellation request to provide documentation or evidence supporting their claim and justifying the requested refund. If such documentation is not submitted within the indicated period, it will be understood that the Tenant has withdrawn their request and will consequently forfeit the right to a refund.
  • The Advertiser will be informed by email sent by idealista about the cancellation request and the evidence submitted by the Tenant. From the time of this notification, the Advertiser will have 1 business day to submit any arguments or claims they deem appropriate. If no response is received within this period, it will be understood that the Advertiser does not oppose the cancellation.

In the event of a full refund to the Tenant, this will take place using the same initial payment method or, if the initial payment method does not allow the refund, by another alternative method, (in such case the Tenant must prove the legitimacy and ownership of the new payment method). In the event of a partial refund, the Tenant will receive a refund of 50% of the Booking, minus the Platform Fee, and the Advertiser will receive 50% of the remaining Booking, minus the OLB Fee, (which will be determined based on such 50% corresponding to the Advertiser).

Once a Booking has been cancelled, the dates corresponding to the Booking will be shown as available again in the Advertiser’s calendar.

8.3 Cancellation of a Booking by the Advertiser

Once the Booking has been accepted by the Advertiser, the latter must comply with it and may only cancel it for duly proven reasons of force majeure or by accepting a possible penalty. Force majeure shall be considered to be any event or circumstance that is beyond the Advertiser’s control due to being unforeseeable and unavoidable and that makes it impossible for the Advertiser to fulfil the Booking. By way of example, the following shall be considered force majeure events: natural disasters, strikes, epidemics, pandemics, acts of terrorism, drastic legislative changes, serious injury, illness or death of the Advertiser, serious injury, illness or death of a first or second degree relative, a minor or disabled person of whom the Advertiser is the legal guardian or primary carer, death of a relative up to the third degree of consanguinity, unexpected technical and construction problems of the Property, among others.

The Advertiser must notify idealista as soon as possible in the case of a force majeure event and provide sufficient evidence for the assessment thereof by idealista.

If force majeure is proven, idealista will inform the Tenant and reimburse the full amount of the Booking, including the Platform Fee.

On the other hand, if the force majeure is not sufficiently proven or the cancellation is for unjustified reasons, the Advertiser undertakes and shall be obliged to provide the Tenant with a Property of equivalent or superior quality for the same dates as the Booking and must bear any expenses that may be incurred due to such unjustified cancellation. If the Advertiser seeks a solution and the Tenant accepts it, the situation shall be deemed to have been resolved. On the other hand, if the Advertiser does not offer an alternative or the Tenant does not accept it, idealista will refund the full amount of the Booking, including the Platform Fee, and will help the Tenant, as far as possible, make a new Booking Request. For the avoidance of doubts, the aforementioned reimbursement will take place as long as the cancellation by the Advertiser is prior to the first 48 hours after arrival at the Property. After such time, once the funds have been released to the Advertiser, any dispute between the Tenant and the Advertiser must be directly settled between them through the relevant legal channels.

In addition, in the event of unjustified cancellations, idealista may impose the following penalties on the Advertiser:

A financial penalty of up to (i) 30% of the amount of the Booking, in the event of cancellation within 15 days prior to the Booking Start Date; (ii) 20% of the amount of the Booking, in the event of cancellation within 30 days prior to the Booking Start Date; or (iii) 10% of the amount of the Booking, in the event of cancellation within 60 days prior to the Booking Start Date, always with a minimum of €50. The Advertiser authorises idealista to collect all the amounts owed for the OLB Service, with no further action being required, by means of a charge through the payment method associated with the corresponding Booking or any other registered payment method.

In particular, the Advertiser expressly authorises idealista to collect any amount related to (i) the Booking, (ii) the OLB Service, (iii) the OLB Fee, (iv) the Cancellation Policy, (v) bank charges, if any, (vi) amounts payable for agreed fees and (vii) any other amount that may be applicable. Any amount owed and not paid for any reason whatsoever may also be subject to the legal actions idealista is entitled to file.

Penalties in positioning or visibility in the alerts or list of results, forfeiting all the positioning points available at the time of applying this penalty.

This penalty will be applied on a daily basis to be determined by idealista, depending on the conduct of the Advertiser and the warnings previously provided thereto. The penalty consisting of the forfeit of positioning may be extended up to 30 days and will be applicable to all the listings posted by the Advertiser at any given time. Moreover, the penalty by blocking the calendar for the listing may be extended up to (i) 30% of the days of the Booking, in the event of cancellation within 15 days prior to the Effective Start of the Booking; (ii) 20% of the days of the Booking, in the event of cancellation within 30 days prior to the Effective Start of the Booking; or (iii) 10% of the days of the Booking, in the event of cancellation within 60 days prior to the Effective Start of the Booking, always with a minimum of 1 day. In any case, the Advertiser will be duly informed by idealista of the reasons for its decision and will be allowed to submit the allegations it deems relevant in this respect.

9. The liability of idealista

idealista acts as a technological platform in the OLB Service and simply facilitates the agreement between the Tenant and the Advertiser to book a specific Property. We do not act as intermediaries or representatives of any of the parties involved in the OLB Service. We are not a real estate agency and we are not in the business of renting properties. To the extent possible and within the permitted limit, our liability system is the same as the one set out in idealista’s General Terms and Conditions.

Therefore, the liability of idealista is limited to the following:

  • Making an online space available to Advertisers and potential Tenants for rendering the OLB Service.
  • Once the Booking has been accepted by the Advertiser, managing the initial payment made by the Tenant on behalf of the Advertiser, in accordance with the Booking Conditions.

By accepting the OLB Terms and Conditions, the Tenant and the Advertiser entrust idealista with the management of the Booking through its technological platform. Therefore, idealista only provides a technical tool for managing the Booking, including the payment of the Booking through its payment service provider.

Any legal, administrative, tax, fiscal, or other responsibility arising from the contractual relationship between the Tenant and the Advertiser or, where applicable, the owner of the Property rests solely with them. It is imperative and mandatory that the Tenant and the Advertiser or Property owner formalize the corresponding rental agreement, assuming directly and exclusively all related procedures and formalities. Signing this contract is not optional but an inescapable obligation of the Tenant and the Advertiser or owner, who expressly acknowledge and assume it. Likewise, they will be solely responsible for any invoicing or tax declaration obligations that may apply.

In the event that the Tenant and the Advertiser formalise a Booking by a method other than the idealista platform, idealista will not accept any responsibility in relation to the fulfilment of the Booking Conditions, (including the Cancellation Policy).

The Tenant and the Advertiser agree to exempt, indemnify and hold idealista harmless for any claims, damages, losses and expenses arising from: (i) breach of the OLB Terms and Conditions and idealista’s General Terms and Conditions; (ii) improper use of the OLB Service; (iii) interactions with other users; (iv) the Tenant’s stay in the Property; (iv) the omission or inaccuracy of statements, data, information or documents; (v) infringement of the law or violation of third party rights, as permitted by applicable law; or vi) any issue arising from the contractual relationship between Tenant and Advertiser, since the rental agreement is exclusively between them, without idealista being a party to it.

The failure by the Advertiser to fulfill any obligation of compensation, reimbursement, or indemnification provided for in these OLB Conditions constitutes sufficient grounds for idealista, by means of written notice to the Advertiser, to terminate for just cause any other contract it maintains with the Advertiser, regardless of its nature, without prejudice to idealista’s right to demand payment of amounts owed or to exercise any other legally provided rights or actions.

10. Online Booking with Insurance

If you use an ad/booking with insurance by Chubb, Chubb processes basic personal and contact data, among others, that you provide through idealista for purposes of underwriting and policy management, claims handling, and other insurance-related purposes, as detailed in the Privacy Policy, which also explains how data subjects may exercise their data protection rights.

10.1 Conditions Applicable to Advertisers

  1. By including the Chubb European Group SE, Spanish Branch (“Chubb”) insurance option in the listing, you expressly declare that you are the sole owner of the Property or are duly authorized to publish and lease it.
  2. If you are authorized by the owner, you assume responsibility for conveying all information related to the insurance to the owner, in accordance with applicable regulations. idealista is not responsible for any failure by the Advertiser to comply with pre-contractual information duties or any other obligations derived from insurance regulations.
  3. You may download the coverage table for insured parties and the summary of coverage for the ROL insurance. The group policy number ESPRE248143, for which idealista is the policyholder, is free of charge for insured parties (landlord and tenant).
  4. idealista acts solely as the policyholder of the mentioned group insurance policy and is not responsible for the marketing or intermediation of insurance products. As an Advertiser, you acknowledge that idealista does not perform the functions of an insurance agent or broker and assumes no responsibility for the conditions of the insurance offered by Chubb or any matters related to insurance market regulation.

10.2 Conditions Applicable to Tenants

  1. As a Tenant, you have the option to book a Property that includes Chubb insurance under the “Online Booking with Insurance” model. This information will be clearly and accessibly provided before completing the booking, including access to download the coverage table for insured parties and the summary of coverage for the ROL insurance.
  2. The Chubb insurance included in the group policy number ESPRE248143, for which idealista is the policyholder, is completely free of charge for Tenants.
  3. idealista acts solely as the policyholder of the insurance policy and not as an insurance agent or intermediary in the marketing of insurance products. Under no circumstances will idealista provide insurance product advice or mediate in their contracting.
  4. idealista assumes no responsibility towards the Tenant regarding the coverage, validity, or terms of Chubb’s insurance, which will be subject exclusively to the conditions of the group policy and Chubb’s decisions. idealista will not be liable for any claims related to the management, interpretation, or application of insurance regulations, nor for any incidents.

Important: If the Booking is extended by mutual agreement between the parties, the insurance described in this section will no longer be valid once the initial coverage period stated in the policy ends. There is no automatic renewal or extension of the insurance beyond that period.

11. Personal data protection

You can obtain detailed information on how and for what purpose we will process your data within the framework of the OLB Service and any other services you request from idealista by consulting our privacy policy.

12. Applicable law and jurisdiction

These OLB Terms and Conditions are subject to the laws of Spain. Any provision in the OLB Terms and Conditions that is or becomes illegal, null and void or unenforceable shall be excluded and replaced by a provision that is as similar as possible thereto, without resulting in any compensation. In such case, all the other provisions or paragraphs therein shall remain the same.

Any dispute that may arise related to the interpretation or application of these Terms and Conditions shall be submitted to and settled by the Courts and Tribunals of the city of Madrid or by those that may be applicable according to the domicile of the party concerned.

In order to comply with the requirement of admissibility set out in Article 5 of Organic Law 1/2025, of 2 January, on measures regarding the efficiency of the Public Justice Service, when applicable, the appropriate means of dispute resolution shall be direct negotiation between the parties. You must send an invitation to such negotiation to idealista via email, with proof of delivery and read receipt, to the following address: reclamaciones@idealista.com.

If you are a consumer or user, please note that the requirement of admissibility will be considered fulfilled if: (a) you send us a prior out-of-court claim and we fail to respond within the legally established period, or if our response is not satisfactory; or (b) you resort to one of the alternative consumer dispute resolution procedures established in Law 7/2017, of 2 November, which transposes Directive 2013/11/EU of the European Parliament and of the Council of 21 May 2013 on alternative dispute resolution for consumer disputes into Spanish law, or any other procedures established by sector-specific regulations implementing the same. For these purposes, the Ministry of Social Rights, Consumer Affairs and the 2030 Agenda publishes a list of entities notified to the European Commission by the competent authorities in Spain for the alternative resolution of consumer disputes.

For the avoidance of doubts, idealista does not undertake any commitment nor is it obliged to use an alternative dispute resolution institution to settle disputes with consumers.
