idealista (Idealista, S.A.U., our legal name) is the company that manages this website and apps. Our headquarters are in Madrid, in Plaza de las Cortes (yes, next to the famous lions). We are registered in the Commercial Registry of Madrid and our Spanish Tax Identification Code (NIF in Spanish) is A-82505660.
What services do we offer?
We place a space at your disposal where you can post or search for listings of properties for sale or rent, whether it’s an apartment, a room in a shared flat or a parking space, just to give a few examples. We also offer other services related to the real estate sector, such as property valuations and energy certification services, to give you a complete experience.
What can and can’t you do in idealista?
You can browse the Website and Apps, sign up to be able to save your searches and favourites, contact advertisers, post properties for sale or rent, and hire other additional services.
You may not harm third parties or idealista, commit unlawful acts, use automatic mechanisms to copy or extract our content, create fake accounts or establish false contacts, or use other users’ passwords without their consent.
If you are an advertiser, we recommend that you also read our rules for posting listings carefully.
Who owns the content of the Website and Apps?
idealista is the owner of all the content, images, brands, logos, videos, texts, etc. that appear on the Website and Apps (or belong to third parties who have given us their permission). Furthermore, by sharing material on idealista, you authorise us to keep using it even when your listing has been deleted, for our price reports or historic references of the real estate market, or for the idealista/maps for example.
What now?
Now comes the part that will put your language skills to the test, where the legal jargon (which is what binds us) shines in all its glory. This might be a good time to eat a bit of chocolate (the darker the better) and get ready. Here we go:

1. Purpose and general information
idealista S.A.U (hereinafter, “idealista”, “us” or “we”) make these terms and conditions (hereinafter, the “General Conditions”) available to you, which regulate:
- The access, use, browsing and registration on the website located under the domain name www.idealista.com and its respective subdomains, or mobile applications, owned by idealista (hereinafter, the “Website and Apps”).
- The downloading and use of any information, text, images or other content that you can access via the Website and Apps.
Our goal is for you to know more about what we do, how our Website and Apps work, as well as the services we offer. idealista values its users and the trust they place in us when using our services or accessing the Website and Apps is fundamental. That’s why we want to repay that trust by providing our users with information about our services in a simple and easy-to-understand way.
What is www.idealista.com?
Our website, hosted under the domain www.idealista.com, and its subdomains contain a technological platform that we make available to our users so that they can post listings for the sale or rental of real estate, or search for a property (hereinafter, the “Main Services”).
idealista merely facilitates the contact between users who are offering properties and those who are looking for properties. idealista does not intervene in any transactions that may arise from these contacts. idealista is not a real estate agency, nor are we involved in selling and/or renting properties. In this context, we offer some additional related services (hereinafter referred to as the “Additional Services” and, together with the “Main Services”, the “Services”). You can find more information about our Additional Services in Clause 7 of these General Conditions.

idealista is the owner of this Website and the Apps, with the following corporate information:

2. Access and acceptance of the General Conditions
When accessing or using the Website and Apps, you are doing so under your sole and exclusive responsibility, and assume the status of user (hereinafter, “User” or “Users”), which implies that you have read and that you understand and unreservedly accept these General Conditions in their latest published version. In the event that you use Services requiring registration, whether as a private user or professional user, you will become a registered User (hereinafter, “Registered User” or “Registered Users”). This also implies that you accept any and all specific conditions that may replace, add to, and/or modify these General Conditions (hereinafter, the “Specific Conditions”), as applicable in each case.
We reserve the right to expand, modify, replace and/or cancel our Services and/or these General Terms and Conditions at any time. In any case, we will do our best to notify you of any significant changes to the General Conditions sufficiently in advance. In particular, if you are a Registered User, we will notify you by email to the email address you provided us during your registration. We will also update the “date of last update” at the top of these General Conditions. We advise you to review these General Conditions frequently to be aware of any changes we may have made. To the extent permitted by law, idealista shall not be liable for any changes made to the General Conditions or the Services.
If you access the Website and Apps or use the Services after any change is made to the General Conditions, you will be expressly accepting the new General Conditions.
If you do not agree to these General Conditions or any modifications that may be made to these General Conditions, you should stop using the Website and Apps or the Services. By continuing to use them, you agree to the changes made to the General Conditions.
For the sake of clarification, these General Conditions and, if applicable, the Specific Conditions, will apply to both private Users and professional Users. However, the provisions of these General Terms and Conditions shall not affect the statutory rights held by consumers and users.
3. Minors
The Services provided by idealista are not intended for minors under the age of 18. By accessing or using our Website and Apps or Services, you state and warrant that you are 18 years old or over.
4. Terms of use and responsibility for the use of the Website and Apps
Any use of the Website and Apps must comply with these General Conditions and the Specific Conditions, where applicable, idealista’s publication policies and guides available in the user support section, current laws, good morals, decency, and public order.
You may not use any of the above unlawfully, inappropriately, or in any way that violates any provision in these General Conditions or the Specific Conditions, where applicable. In order to facilitate your browsing and use of our Website and Apps, here is a list of what you may or may not do:
You may
- Access and browse the Website and Apps without needing to register, completely free of charge.
- If you decide to register, use our two-step access system with verification to strengthen the security of your account and ensure that no one else can access it without your consent.
- Receive alerts on new properties and save properties that may interest you as favourites.
- Contact the advertisers of the properties you are interested in.
- Fine-tune your profile in the specific event that you intend to lease a property or rent a room.
- List properties for sale or rent (properties, rooms, storage rooms, buildings, garages/parking spaces, business premises, offices or land) that you own or manage
- Sign up for Additional Services related to the property you are listing or enquiring about on the Website and Apps.
You may not:
- Enter, share, disseminate or publish:
- Content that is of a racist, xenophobic, obscene, or denigrating nature (for example, listings that refer to the origin or nationality of those interested in the property or that include insults or profanity of any kind).
- Content that incites, involves, or promotes criminal, terrorist, violent, or defamatory acts based on age, gender, religious or other beliefs (for example, listings that refer to or express preferences about the sexual orientation, age group, or religion of those interested in the property).
- Content that violates the fundamental rights of third parties in any way.
- Information that constitutes unlawful or unfair advertising (for example, listings with fictitious prices or that include misleading or offensive comments about competitors).
- Content that violates the privacy of communication and/or the applicable laws on personal data protection (e.g. listings that reveal the identity of owners, occupants, or any third parties who have not given their consent to make their data public).
- False, inaccurate, or fraudulent content that could mislead the recipients of such information (for example, listings containing misleading descriptions or false details about the properties).
- Use the Website and Apps for illicit purposes or for the resale, transfer, or disposal for the use or benefit of any other person or entity.
- Cause damage to IT systems owned by idealista or third parties, or insert or spread computer viruses or any other kind of harmful system that could damage IT systems.
- Carry out acts that in any way infringe idealista’s intellectual property rights and/or harm idealista’s reputation or that of third parties.
- Use the identity and/or login details or password belonging to another Registered User without their consent.
- Access, monitor, or copy any content or information included on the Website and Apps using any kind of robot, spider, scraper, or any other automatic or manual process to do so for any such purpose, without our express written permission.
- Violate the restrictions contained in the robot exclusion checkers included on this Website and Apps, or bypass or circumvent other measures used to prevent or limit access to this Website and Apps.
- Take any action that imposes or that may impose, in our judgement, an unreasonable or disproportionately large burden on our infrastructure.
- Set up a link to any content on the Website and Apps for any purpose without our express written consent.
- Replicate, display, mirror, or otherwise incorporate any content from this Website and Apps into any other website without our prior written consent.
What happens if you do any of these actions, breach our conditions or publish illegal content in general?
If you engage in any of these behaviours, you will be liable for any damages that may result and you agree to indemnify and hold idealista harmless.
Furthermore, in the event of a direct or indirect breach of these General Conditions, the Specific Conditions applicable to you, or current applicable law, we may remove, block, or restrict the visibility of your listings and/or content and, upon prior notice, we reserve the right to delete your account, as well as to suspend or limit access to and use of our Website and Apps and our Services, without this resulting in any compensation on our part.
To determine the scope and duration of the measure taken in such cases (for example, the relegation of the listing to the bottom of the results list for a period of 30 days), we will take into account the number of breaches and/or unlawful uses made, the seriousness and nature of the acts, and the existence of a deliberate intention, among other factors.
If you do not agree with the decisions made by idealista regarding the moderation and content control policy on the Website and Apps, you can state your reasons by contacting us directly at the same email address we used to inform you of our decision. Please note that the deadline for you to submit your objection is 6 months from the date on which we notify you. In addition, the User in question may contact any certified independent dispute resolution body. He/she may also take legal action pursuant to the provisions of clause 15 of these General Terms and Conditions.
What happens if you detect someone else is doing it?
If you become aware of any use contrary to these General Conditions or the Specific Conditions or if you become aware that any illegal action is being taken or that any right of yours, idealista’s, or third parties is being violated, please inform us as soon as possible using the means provided for this purpose on the Website and Apps (“Have you seen an error?” form available in the listings or in the contact form).
In addition, if you belong to or act on behalf of an authority (police, judicial, or administrative), you can ask us for information or report any improper or unlawful action by sending us an email directly to autoridades@idealista.com.
idealista takes all reports of illegal or inappropriate content very seriously. As soon as we receive a complaint, whether from other Users or from the competent authorities, we immediately analyse the incident thoroughly.
If you communicate with us in this regard and provide us with your data, we will notify you as soon as possible of our final decision and any measures we may take in relation to the content or action reported. If you do not agree with our decision, please let us know by sending your reasoning to the email address we used to notify you. Please bear in mind that the deadline for doing so is 6 months after notification. There is also the option of contacting any certified independent dispute resolution body or taking direct legal action pursuant to the provisions of clause 15 of these General Terms and Conditions.
Which tools does idealista use to detect illegal or inappropriate behaviour?
Maintaining a safe and respectful environment for all Users is a priority for us. This is why, in addition to the contact mentioned above for reporting any illegal or inappropriate content on the Website and Apps, we have a team of professionals who are responsible for ensuring the quality of the listings posted and that they comply with current laws and our policies.
We have therefore implemented machine learning tools that help us identify, using specific keywords, comments on listings that may violate the law and/or these General Conditions. We also have a multimedia content review programme that, among other things, is able to recognise text in published images. If specific words or inappropriate content are identified in the images, our specialised team will immediately review them.
Ultimately, we are committed to ensuring transparency, security, and legality on our Website and Apps and these measures, along with the notification mechanisms available to our Users, are an essential part of that commitment.
5. Posting listings
You will need to register and provide us with all the information necessary to register as an advertiser in order to be able to promote your property on our Website and Apps by posting a listing. To do this, you must fill in the information and provide the documents we request, otherwise you will not be able to access our Services or post listings.
If you are denied hiring or the provision of our Services due to a lack of or insufficient information provided, and if you do not agree with our decision, you can notify us within 6 months at the email address we provide you with. This is without prejudice to the possibility of resorting to certified independent dispute resolution bodies or the courts to resolve any discrepancies.
By posting a listing, you warrant that all the information included in it is truthful, accurate, complete, and up-to-date. At idealista, we strive to check the veracity and accuracy of the information published in the listings, but we cannot completely guarantee the veracity of such information. It is your obligation as an advertiser to keep the information up-to-date at all times and to notify us as quickly as possible if any of the information becomes outdated or is inaccurate. You are also required to comply with applicable laws regarding the listings you post; including, any legal provisions relating to renting and/or buying and selling property.
In addition, by posting a listing, you acknowledge that you are the owner of the property you are listing or you are duly authorised to list it by the owner (and any co-owners, if applicable) and that you are solely responsible for the veracity of the information published, and consequently you will be exclusively liable for any damages that may arise from the posting. Furthermore, in the case of hiring multimedia Services, you expressly state that you have sufficient capacity to authorise idealista to collect images of the properties. Therefore, you acknowledge and accept that you hold idealista harmless against any claim that may directly or indirectly result from collecting and recording these images and their subsequent publication on the Website and Apps.
Finally, idealista accepts no liability for anything that goes beyond what is described in these General Conditions and in applicable law. The price and other information contained in each listing regarding the properties posted on the Website and Apps does not constitute a sale offer on our part.
How do we position listings?

Posting Service for Private Advertisers
To post a listing for your property, you just have to follow the steps outlined on our Website and Apps. Upon completing the process to post a listing, if you are a private advertiser (hereinafter, “Private Advertiser” or “Private Advertisers”), you will have to validate the telephone number provided in the listing and to this end you will receive a confirmation email at the address provided during registration. This validation may involve an additional cost if the telephone number supplied is a landline or an international number.
In order to prevent the existence of listings of properties that have already been sold or leased, we ask Private Advertisers to confirm their listings periodically. For this purpose, please bear in mind that:
- Sales listings must be confirmed every 330 days.
- Rental listings must be confirmed every 150 days.
If we do not receive confirmation that a listing is still on the market within the above deadlines, we will cancel the listing until it is reconfirmed by the Private Advertiser. The end date of the posting is not altered by the fact that the listing has been removed due to lack of confirmation.
Free Nature of the Posting Service for Private Advertisers
If you are a Private Advertiser, you acknowledge that the use of the free service for posting listings is limited to the posting of a maximum of two properties (for sale and rent), which you may keep posted for as long as you like, until they are sold or rented; except in cases where the posting must be paid for, which happens whenever at least one of the conditions indicated in our Pricing and Payment Policy for individuals is met.
On the other hand, listing rooms in shared accommodations allows you to advertise up to 5 rooms for free.
All this without prejudice to the “hide address” feature, which is optional and will entail a cost that will be specified at the moment the property is listed.
Once you have used up your quota of free listings, if you want to post an additional property that is not a room to let, you must purchase one of the paid advertising services on idealista. With regard to these paid services, bear in mind that:
- We never charge for any listing until it is posted.
- When we receive a new listing, it undergoes technical quality control checks and, once these have been completed, we post the listing and collect payment for it.
- If there is a problem, we let you know so that you can solve the issue and we don’t charge you anything until the listing is posted.
- You can pay via any of the methods set out in section 10 on payment methods for the Website and Apps.
- If a listing is withdrawn before the contracted period, no refund will be made of any amount paid for its posting.
Finally, bear in mind that idealista may keep some data from the date of deactivation of the last listing in order to prevent the misuse of the free service, or fraud of any kind. For more information, please refer to our Privacy Policy.
Posting listings and Other Services for Professional Clients
The Services offered for professional clients (hereinafter, the “Professional Client” or “Professional Clients”), including, by way of example and without limitation, the posting of listings, shall at all times be subject to the signing of a services contract and to the financial consideration established at any given time for each of the Services for Professional Clients, which shall be paid subject to the terms set out in the relevant contract.
Professional Clients must provide idealista with all the information requested when contracting the Services. If idealista has sufficient reason to believe that the information provided is inaccurate, incomplete, or outdated, it will ask the Professional Client to rectify it and may suspend providing the Services until this request has been duly complied with in full. If the Professional Client does not agree, they may appeal idealista’s decision within 6 months of notification in writing to the same email address from which they were contacted or refer the matter to any certified independent dispute resolution body or the courts.
The listings posted by Professional Clients may also be posted on other portals owned by idealista (for example, on www.yaencontre.com unless such Professional Clients expressly oppose to it or, subject to their prior agreement, on third-party portals with which idealista maintains a partnership for this purpose. In addition, if they have contracted the idealista rental management software, Rentger (www.rentger.com) Professional Clients will be able to connect their idealista/tools account and import their properties posted on the Website and Apps to Rentger, in order to manage the rental agreements signed for these properties with this software.
6. Rules for posting listings
By using the services for posting listings, you agree:
- Not to post duplicated images or images with any kinds of frame, watermark, logo or text, nor compositions of several images or videos based on photographic montages of the properties.
- Not to post listings with no images or with images, plans or any other kind of multimedia content (such as videos, virtual views or 3D images) that are not relevant to the listing (including, for example, empty images, monuments, tourist or shopping areas around the property, animals or people).
- Not to post listings with images, plans or any other kind of multimedia content (such as videos, virtual views or 3D images) that do not correspond to the listed property or are not related to the listed transaction (for example, images or videos related to the advertiser’s own professional activity or of a property other than the one posted).
- Not to publish multimedia content of one’s own or created by third parties, by contracting the relevant viewing service, with inappropriate, defamatory, unlawful themes, materials, or information that violate any third party rights (including, in particular, image rights, data protection, or intellectual or industrial property rights); which contain the advertiser’s contact details, watermarks, logos or texts; or that are irrelevant or unrelated to the listed property.
- Not to post more than 3 (three) photographs of the area (surrounding area) where the property is located. idealista reserves the right to remove such images automatically.
- Not to include information in the description of the listing that is not relevant or unrelated to the listed property (for example: advertising content about the advertiser, their professional activity, or other properties other than the one listed).
- Not to use capital letters in the description of the listing, beyond the proper use of spelling.
- Not to post new-build properties or promotions within the contracted second-hand posting package, nor vice versa. For more information on the types of properties that can be posted, please see here.
- Not to post properties with a transaction type other than the one contracted (sale/rental).
- Not to post more than 1 (one) listing for the same property simultaneously, nor add or remove the same properties repeatedly.
- State if you are publishing a property in the form of co-ownership, in which case you must also have a specific agreement with idealista for posting listings of this kind.
- Not to add more contact numbers than those allowed for the type of package contracted.
- Not to add additional telephone numbers or contact emails outside the space intended for that purpose in the listing.
- Limit the number of logins to the maximum number specified in accordance with the type of package contracted.
- Not to post properties in areas other than the contracted area.
- Provide a single business address for posting property listings. If you have several business addresses, you will have to purchase a publication package for each business address that you are going to use.
- Not to post properties that will not be available in the near future, nor advertise properties that are already reserved, sold or rented.
- Not to post property listings for holiday rentals or tourist use, except when expressly authorised by idealista. In these cases, you must have all the necessary permits and government authorisations to carry out the activity and include the registration number in the relevant public register in your listing, where legally required.
- Not to label a photo of the listing as a “floor plan” if it is not of a floor plan.
- Insert the exact address in order to geolocate the property correctly, even if the “hide address” function is activated. Please note that, if you are a Private Advertiser, this optional feature “hide address” entails an additional cost that will be specified at the time the listing is posted.
- Not to publish inaccurate prices (for example, state that the price includes a parking space and add the additional price of the parking space in the property description).
- Specify the energy class together with an image of the energy efficiency certificate that proves that the property has the certificate.
- Include in the listings any information that may be mandatory in accordance with state, regional or local regulations in force, and which may be applicable from time to time.
- In general, carry out any misleading conduct with the aim of obtaining an illicit placement in the listings of the Website and Apps or causing the sending of misleading alerts to Users (for example, uploading and removing the same images or changing the description of a listing repeatedly and without apparent justification).
If you are a member of a franchise network, association, multi-agency, or any other organisation of a similar kind (whether operating with the same tax identification number or with a different number), you undertake not to duplicate the same listing/property that may be posted on the Website and Apps by other franchisees, associates or agents of your organisation in the same period of time; all of this regardless of the use of different trademarks, logos or trade names, or the execution of independent publishing contracts between idealista and the different franchisees, associates, agents or consultants of its network or even the authorisation in favour of any of them by the owner to manage the property.
You acknowledge that idealista reserves the right to (i) apply penalties to the posting of listings; or (ii) delete listings that do not comply with these posting rules or the General Conditions and/or the Specific Conditions, if applicable.
Measures to combat fraud or breaches to these General Conditions
In order to prevent fraudulent use of the Services, you acknowledge and accept that idealista may quarantine and apply penalties to the positioning or visibility of any listings containing material suspected of being fraudulent or in breach of these General Conditions. In this case, you will be duly informed by idealista of the reasons for the decision and will have the opportunity to present any arguments you deem pertinent.
Quarantined listings will not be visible on the Website and Apps until their legality can be verified.
In order to provide truthful information to our Users, idealista may penalise advertisers who violate the aforementioned posting rules with the aim, for example, of obtaining the illicit positioning of their listings on the Website and Apps or to artificially trigger the sending of alerts to Users.
Listings penalised for these reasons will lose all the positioning points they have at the time of the penalty and will not appear in User alerts. In this regard, the penalty will be applied on a daily basis to be determined by idealista, depending on the behaviour and warnings given to the advertiser, and may be extended up to 30 days.
Penalties resulting from the misuse of our Services will be communicated to the advertiser and will apply to all listings published at the time on the Website and Apps.
idealista shall have the right, but not the obligation, to investigate all instances of fraud that are reported by Users, in which case the advertiser must cooperate in the investigation.
By using this posting service, you acknowledge and accept that idealista is not liable for any harm or loss, whether direct or indirect, that may result from the fraudulent use of these Services and, in particular, from the application of the anti-fraud measures and mechanisms, including but not limited to:
- loss of income or earnings;
- loss of business;
- loss of profit or contracts; and
- loss of data.
idealista reserves the right to implement any other anti-fraud measures it deems appropriate or necessary from time to time. In such cases, the User concerned may appeal the decision and measures adopted by idealista pursuant to the provisions of clause 4 of these General Conditions
Through these General Conditions, you accept that when the listing has been posted with your consent, at the end of the posting process, you will lose the right of withdrawal, based on the provisions of Article 103.m) of Royal Legislative Decree 1 of 16 November 2007, which approves the Amended Text of the General Act for the Defence of Consumers and Users (if applicable).
For clarification purposes, these posting rules shall apply to both Private Advertisers and Professional Clients who post on the Website and Apps.
7. Additional services
As we mentioned at the beginning of these General Conditions, apart from the use of the Website and Apps and the Main Services aimed at connecting people offering property, by posting listings, with those looking for it, we also provide a number of Additional Services, which can be provided directly by us or by other companies (of the same group or not) that we work with. To be specific, we have the following services:
- Service to apply for energy efficiency certification, with the collaboration of Certicalia (WSCERTICALIA 2012, SL).
- Solar energy services or other energy solutions provided by third-party operators.
- Mortgage brokerage service provided by Idealista, Crédito y Financiación, SL (idealista/hipotecas). See the terms and conditions for this service.
- Insurance mediation service conducted by Idealista World Agencia de Seguros Vinculada, SLU (idealista/seguros). See the terms and conditions for this service.
- Opportunities for professionals interested in collaborating in the real-estate credit brokerage business of idealista/hipotecas or in the insurance mediation business conducted by idealista/seguros.
- Participation in webinars for professionals.
- Property valuation service (unofficial valuations).
- Property exportation service.
- Sending of information about similar properties that may be of interest to you.
- API service.
- Service for database of delinquent tenants offered by Base de Datos de Morosidad Inmobiliaria, SLU. See the terms and conditions for this service.
- Financial investment calculation services provided by FINECT.
- Refurbishment calculator service (estimated appreciation in value), with the possibility of contacting third-party refurbishment companies to request quotes.
- Advanced electronic signature service, either through idealista or a third-party collaborator (Signaturit), in the following cases:
- Service for drawing up and signing the rental agreement. See the terms and conditions for this service.
- Provision of an advanced electronic signature service for Professional Clients, through idealista/tools, for their own clients, of certain documents related to the sale or lease of properties. Professional Clients shall be exclusively responsible for the contents of such documentation, as well as for the data of clients or third parties provided by them, where applicable, for this service. - Multimedia services to help you improve your listing (photo book, video or virtual tour).
- Support service to help you sell or lease your property, which allows property owners to get in touch with Professional Clients who can help to sell or lease properties. By using this support service (either as an owner or as a Professional Client), you acknowledge and accept that the property to be marketed by the selected professional must be advertised preferentially on idealista.
- Duplicate service (DeDup), to identify duplicate listings from various internet sources. This is a search engine that allows you to group listings posted on several websites or web applications that refer to the same property. This service shows basic public information and links to the various listings found of a specific property, which can be accessed to obtain more details.
Please note that these Additional Services may be subject to Specific Conditions that are different from these General Conditions
8. Intellectual and industrial property
8.1. Materials and information contained on the Website and Apps
Through these General Conditions, you acknowledge and accept that all rights regarding the material and elements appearing on the Website (including, but not limited to, drawings, text, graphics, maps, photographs, images, audio material, video material, distinguishing marks, logos, trademarks, trade names, domains, software etc.) belong to idealista or, where appropriate, to third parties who have consented to the transfer thereof to idealista, consequently, we have all the necessary rights and licenses for the use of thereof.
The fact that we allow you to access, use, browse, and/or download material from our Website and Apps in no way implies that we waive, transmit or grant any licenses or transfer of our rights, or that you acquire ownership thereof. As a User or a Registered User, you are only entitled to a personal and private use right, solely in order to benefit from the Service. Consequently, you cannot manipulate any identifying element from idealista or the respective owners. In particular, the use of any material or elements from the Website and Apps for inclusion in whole or in part on other websites or apps without our prior written permission is prohibited. The use of any element or information in such a way so as to give the impression that it belongs to or is associated with the User or Registered User is likewise prohibited.
In particular it is not permitted to re-sell, deep link, use, copy, monitor (for example, spider, scrape), display, download, save or reproduce the content, information, software, products or services available on our website for any commercial or competitive activity without our prior written permission.
8.2. Material posted on the Website and Apps
The materials and information that you publish on our Website and Apps when using the Services (including the multimedia viewer integration service generated outside idealista) must respect the image rights, data protection and intellectual and industrial property that may exist on them. Therefore, you acknowledge and agree to assume sole responsibility for any liability or damages that may arise in relation to them.
By disclosing or posting information, non-personal data, photographs or any other material with us (including internal messages on the Website and Apps), you grant us a licence with worldwide effect, for the maximum term of protection permitted by law and with the possibility of sub-licensing such information to related companies and third parties.
In particular, you authorise us to:
- Add idealista watermarks in order to prevent these photographs from being published by unauthorised third parties.
- Use the information about the properties listed on our Website and Apps to carry out property valuations and appraisals, price reports, statistical reports, historical references or other information about the real estate market. This information may be used even after the respective listings have been removed from the Website and Apps.
- Distribute, reproduce, transform and publicly communicate such material.
Likewise, if you are a photographer and you use and/or access our Website and Apps to upload photos, videos and floor plans of homes that are the result of your work or service, by disseminating or publishing information, non-personal data, photographs or any other material through idealista, you grant us a licence with worldwide effect, for the maximum period of protection permitted by law and with the possibility of sub-licensing this information to related companies and third parties. In this regard, you acknowledge that idealista has the right to disclose all or part of the content of the listings for advertising campaigns, promotion of the Website and Apps, blogs, etc.
8.3. Material contained and stored in idealista/tools
All rights to the materials and elements contained in the idealista/tools software are and shall remain the property of idealista or its third-party licensors (as the case may be). Nothing that is set forth in the General Conditions or Specific Conditions may be interpreted as an assignment in favour of the Professional Clients of any image, intellectual or industrial property rights over the aforementioned materials and elements of idealista.
All rights to the information stored by Professional Clients in idealista/tools remain the property of the Professional Clients or their respective third-party licensors.
Notwithstanding the foregoing, by using the idealista/tools software,you grant a worldwide, non-exclusive, irrevocable, royalty-free, transferable and sub-licensable license to idealista to use, copy, store, archive, modify, extract, display, distribute, transmit, transfer, make available, reuse, download and create, among other things, derivative works and data, from any non-personal information you have stored on idealista/tools, in order to:
(a) provide you with the Services you have contracted with us; and
(b) optimise, adjust, aggregate, evaluate, analyse, report and obtain information to improve and develop our Services, as well as any other service, product or technology that idealista provides or may develop and provide, provided that idealista does not disclose for this purpose any information that identifies or could reasonably be expected to identify any party unrelated to idealista, the Professional Client, its brands or its own clients.
The provisions of this section in no way affect idealista’s obligations regarding personal data protection, in accordance with the provisions of the Privacy Policy.
8.4. Granting a license for idealista/maps
Without prejudice to the provisions of Section 8.2 above, by disclosing or posting information, non-personal data, photographs or any other material through idealista, you also grant us, with specific reference to www.idealista.com/maps (hereinafter “idealista/maps”), a licence with worldwide effect, for the maximum period of protection permitted by law and with the possibility of sub-licensing this information to related companies and third parties. In this respect, you acknowledge that idealista has the right to disclose and use all or part of the contents of the listings (prices, photographs, etc.), in order to enable the operation and improvement of the idealista/maps service. In addition, you acknowledge that this information may be used even after the listings have been removed from the Website and Apps, authorising us to distribute, reproduce, transform and publicly communicate this material on idealista/maps.
For clarification purposes, we inform you that idealista/maps shows publicly accessible data for all properties that are registered with the Spanish Cadastral Registry, regardless of whether or not they are posted on idealista. The information that appears in idealista/maps therefore comes from public cadastral registry information and also, if the properties have been posted on idealista, from the public and non-personal data that appear in the corresponding listings. In short, the information on idealista/maps is obtained only from public sources, such as the Cadastral Registry, and from non-personal data from listings posted on idealista (in no case will personal data be shown that allow the identification of the owners or occupants of the property).
Please bear in mind that the price that may appear on idealista/maps for a given property published on idealista may or may not coincide with the final price at which it was sold or leased. The valuations shown are merely estimates obtained by idealista from official Cadastral Registry data and the listings posted on the Website and Apps. Such valuations are not to be considered as an official valuation and can in no case replace a professional valuation.
Finally, we remind you that the fact that a property is visible in idealista/maps does not mean that it is available for sale or lease. If a property is available, we will inform users specifically of that situation.
9. idealista’s liability
Our liability is that legally established by Act 34 of 11 July 2002 on Information Society and Electronic Commerce and by Regulation (EU) 2022/2065 of the European Parliament and of the Council of 19 October 2022 (Digital Services Regulation), which state that, in general, we cannot be held liable for information published at the Users’ request.
Although we strive to ensure that the content posted is correct, we are under no obligation to exercise prior control over the truthfulness, accuracy, lawfulness, relevance or suitability of the material published on the Website and Apps, as it is stored at the Users’ request. However, in the event of detecting or suspecting any unlawful act or any act contrary to these General Conditions or the Specific Conditions, we will act with due diligence to remove the information concerned or make access to it impossible in accordance with the regulations in force.
idealista accepts no liability whatsoever for any damages or losses that may arise from the relationship between Users as a result of their contacts or negotiations.
The Additional Services shall be governed by the terms set out in the Specific Conditions, and idealista, in relation thereto, bears the responsibility that corresponds to it by law or under the contractual terms and conditions. Regarding the advanced electronic signature service, idealista shall not be liable under any circumstance for documents unsuitable for signature, uploaded, published or sent to other recipients by Users; or that have not been signed validly and/or properly, in accordance with the criteria provided for in applicable regulations and in these General Conditions.
Access to and use of the Website and Apps requires a computer device or equipment and an internet connection and you agree that you will bear the associated costs.
We are not responsible for the existence of any liens, encumbrances, rights, disputes, mortgages, incidents, seizures or redeemable loan that may affect the properties advertised on our website and Apps, and you agree to hold idealista harmless from any liability or damage in this regard.
We are not responsible for the accuracy, completeness, truthfulness, lawfulness or suitability of the information, materials and/or content available on third-party websites that you may access through links available on our Website and Apps.
idealista’s liability for using artificial intelligence
idealista uses artificial intelligence technologies to improve the efficiency of certain services. By using our services, Users accept and understand the implications of such artificial intelligence tools and agree to use them in a responsibly and in compliance with the law and third-party rights. Although at idealista we make every effort to be as accurate as possible, we cannot guarantee that errors will not occur when using artificial intelligence technologies, as this is a matter beyond our control (we are not suppliers of these tools and do not manage their operation or development).
Any interaction with our systems involves the processing of data and information of all types, which Users must use with due care so as not to violate the rights of third parties (i.e. they must not use the text, data or confidential information of third parties unless they have express prior authorisation to do so). With respect to personal data, we are committed to protecting the privacy of the Users pursuant to our Privacy Policy, which is regularly updated, as well as the measures adopted for such purpose. Users may not use the personal data of third parties unless they have expressly consented to such use.
10. Payment methods on the Website and Apps
On the Website and Apps you can contract some of our Services such as listing your properties if you are a Private Advertiser, and pay for them directly by credit or debit card (Visa, Mastercard, American Express, etc.) or even with Bizum in certain cases. These payment methods are subject to verification and authorisation by the corresponding issuing entities (card issuers or payment accounts), and therefore, if these entities do not authorise the payment, idealista will not continue with the transaction, which will be automatically cancelled.
For payment by credit or debit card, idealista has installed an e-commerce payment platform provided by banks authorised for this purpose. All data provided to idealista for this purpose is duly encrypted to ensure maximum security and confidentiality, and is stored on a secure server certified according to Secure Socket Layer (SSL) protocol.
11. Contracting with third parties via the Website and Apps
You acknowledge and accept that any contractual or non-contractual relations that you enter into with any advertiser, User, Registered User or third party through our Website and Apps or our Services will be solely and exclusively between you and the other party in question. idealista will not be part of, nor assume any liability for any damages that may arise from this relationship.
Therefore, we recommend that you exercise caution when contacting or contracting with any advertiser, User, Registered User or third party through our Website and Apps. If you have any doubts or suspect that any unlawful activity, fraud or conduct contrary to these General Conditions is taking place, we advise you not to make payment or enter into any contract and to contact us (using the “Have you seen an error?” form available in the listings or our contact form) as soon as you detect it. We will do our best to help you solve the issue.
12. Links or hyperlinks to the Website and Apps
At idealista we are concerned about the integrity of the Website and Apps when they are accessed or viewed from any environment created exclusively by third parties. In this regard, you must request the express written permission of idealista before deep linking or framing this Website or any of its contents. If you wish to do so, when contacting idealista to request permission you must include: a) name, email address and phone number, b) the name of your company, c) the address(es) of the website where the proposed deep linking or framing will appear, and d) specific details of the considered deep linking or framing, including the content or pages of the website to which you wish to deep link or frame.

14. Duration and term

However, a different duration and need for prior notice may be set forth in the Specific Conditions, in the contract signed by Professional Clients or in applicable legislation.
15. Applicable law and jurisdiction
These General Conditions are subject to Spanish law. Any clause of these General Conditions that is or becomes illegal, invalid or unenforceable shall be excluded and replaced by a clause that is as similar as possible, without affecting the User, and without giving rise to any compensation whatsoever. In such case, the remaining provisions and sections shall remain unchanged.
Any dispute that may arise in relation to the interpretation and/or application of these General Conditions shall be submitted to and resolved by the Courts and Tribunals of the city of Madrid, or by those corresponding to the User’s residency.
Without prejudice to the above, if you are a consumer and user residing in the EEA, you can also use the European Commission’s Online Dispute Resolution (ODR) platform to resolve any consumer disputes online at: https://ec.europa.eu/consumers/odr.
