Below, we provide you with a summary of the most important information you should know depending on your relationship with Idealista Crédito y Financiación, S.L. (hereinafter referred to as “idealista/hipotecas”):

I. As a user or individual customer

At idealista/hipotecas, we are responsible for processing the personal data you provide to us and we process them in order to render the services requested by you. When you request a service, this request becomes a contractual relationship, which is the legal basis to be able to process them. We will also send you commercial messages when you have accepted them. If you have authorised the assignment of your data or you have requested us for a service rendered by other companies, the latter will need to have access to your data in order to be able to render the service. As explained below, you can access, rectify or erase your data, as well as exercise other rights, at any time.

II. As a professional customer (legal person) or representative thereof

At idealista/hipotecas, we are responsible for processing the personal data you provide to us and we process them in order to render the services requested by you based on the agreement signed with the company that you represent; the legal basis for this processing is the legitimate interest of idealista/hipotecas. Your data may be shared with idealista/hipotecas’ service providers that must access them in order to render the contracted service. As explained below, you can access, rectify or erase your data, as well as exercise other rights, at any time.

In both cases, we recommend that you read this privacy policy in full in order to learn which data we use from each service you request and for how long we need to store them.

When you click “Contact”, “Apply for a mortgage” or an equivalent button, you state you know and understand the privacy policy of idealista/hipotecas.

1. Data controller: Who is the data controller for your data?

Idealista Crédito y Financiación, S.L., with registered office in Madrid, at calle Cedaceros, 11, 2º H, 28014, assigned Tax Identification Number (NIF) B85348464, and with telephone number 912 183 169, (hereinafter referred to as “idealista/hipotecas”), is the data controller of the personal data that you send through our website and its sub-domains (hereinafter referred to as the “Website”).

We provide information in the following sections about the rights you hold, as well as how we use the personal data that you provide us with through the various forms on the Website, by virtue of the General Data Protection Regulations (hereinafter referred to as the “GDPR”).

2. Purposes of the processing. What can we do with your data?

  1. We manage your personal data in order to render the services you have requested through the Website. The list of services includes the following:
    • mortgage advice
    • mortgage comparison tool
    • mortgage simulator
    • debt consolidation
    • services rendered by collaborators in the insurance, legal, renovation or real estate appraisal sector.
  2. If you make a claim or query, we will process your data to manage them.
  3. If you are a user or individual customer, we will send you commercial messages for the following reasons:
    • To invite you to idealista/hipotecas events.
    • To send you news and offers related to idealista/hipotecas.
    • To send you special news and offers from companies in sectors that will assist you in the process of taking out a mortgage (financial, real estate, legal and insurance sectors).
  4. If you are a legal representative or contact person of a professional customer, we will manage your data in order to keep in contact with the companies you represent and to handle claims for amounts that you may owe us for our services.

3. Legal basis/legal standing. Why can we process them?

The legal bases that allow us to process your data for each of the purposes specified in section 2 are the following:

  1. Contractual relationship: this is applicable when you request one of the services specified in section 2a, even when it is free of charge.
  2. Legitimate interest: to deal with the queries and claims that you send to us (section 2b above) in order to manage the recovery of owed amounts and to keep you up to date on our news. Moreover, if you are the representative or contact person of a professional customer, we have a legitimate interest in keeping in contact with the company you represent and for which we render our services (section 2d above).
  3. Your consent: if you are a user or individual customer, by checking the box included in the sign-up or contact form, you authorise us to send you the messages referred to in section 2c above.

4. Recipients. To whom can we disclose the data?

We can disclose your data to third parties in the following cases:

  • to banking institutions: in order to render the services in which idealista/hipotecas acts as a financial broker, so that they can contact you. Click here to find out the names of the banks
  • to appraisal or insurance companies: when you request any of their services, so that they can contact you.
  • to refurbishment and renovation companies, when you request any of their services so that they can contact you.
  • to Courts, Tribunals or Public Authorities to fulfil any legal requirement.

Moreover, idealista’s data processors may access your personal data, in other words, idealista/hipotecas’ service providers that must access your data in order to perform their duties, including those that render services related to technology, sending advertising campaigns, or sending and receiving documents.

You can request further information about the recipients of your data by sending an email to the email address hipotecas@idealista.com, specifying the specific processing or use for which you require information about the recipients.

5. Provision of data. Where can we send your data?

We do not carry out international transfers of your personal data for any of the specified purposes.

6. Term for storing the data. How long will we process your data?

Depending on each of the purposes for processing your data, the term will be as follows:

  • Throughout the contractual relationship, in other words while you are using our services or while we or the supplier is handling your requests (applicable to section 2a above).
  • Until the query or claim you make has been settled (section 2b above).
  • Until you revoke the consent granted to receive commercial messages or for 4 years counted from the last interaction with us (whichever happens first) (section 2c above).
  • If you are a representative or contact person of a professional customer, during the contractual relationship with the company you represent or until you notify us that you are no longer its contact person (section 2c above).
  • Until you request their erasure (applicable to all the purposes described in section 2).

We would also like to inform you that your data will remain blocked until the legal prescription period expires for any obligations related to the processing purposes specified in section 2.

7. Required updated information

There are fields in the forms that are for mandatory completion, without which we will be unable to provide you with our services. When you click on the “Contact”, “Apply for a mortgage” button (or equivalent) included in the aforementioned forms, you state that the information and the data that you provide are accurate and true.

In order to ensure that the information provided is always up to date and does not contain any errors, please remember to inform us as soon as possible of any changes or rectifications to your personal data by using the following email address: hipotecas@idealista.com.

8. Rights of the data subjects

We hereby inform you that you may exercise the following rights:

  1. he right to access your personal data in order to find out which data are subject to processing and the data processing operations carried out with them.
  2. the right to rectify any inaccurate personal data.
  3. the right to erase your personal data, whenever this is possible (for example, by a legal order).
  4. the right to request the restriction of your personal data processing when the accuracy, legality or need for the data processing is in doubt, in such case, we can keep them to file or defend any claims.
  5. the right to object to the processing of your personal data, when the legal basis that authorises us to process them is our legitimate interest. idealista/hipotecas will stop processing your data unless it has a legitimate interest, or it is necessary to defend claims.
  6. The right to the portability of your data, when the legal basis that authorises us to process them is the existence of a contractual relationship or your consent.
  7. The right to revoke the consent granted to idealista/hipotecas.

You can exercise your rights at any time, free of charge, by sending an email to hipotecas@idealista.com specifying the right that you wish to exercise and your identifying data.

We also inform you that you are entitled to submit a claim to the Spanish Data Protection Agency if you consider an infringement has been committed of the data protection laws when processing your personal data.

9. Confidentiality and security

At idealista/hipotecas, we make all reasonable efforts to keep the personal information, which is processed through the Website, confidential. We maintain strict levels of security in order to protect the personal data we process against accidental loss and unauthorised access, processing or disclosure, bearing in mind the state of the art, the nature and risks to which the data are exposed. However, we cannot be held responsible for the use you make of the data (including the username and password) used on idealista/hipotecas that is not through our website.
