The Consell de Mallorca will now impose fines of €80,000 on anyone who illegally rents a property for tourist purposes. In addition, the fines set by law on this matter range from €40,000 to €400,000, and until now, only the lightest sanctions have been imposed.
The proposed penalties to be imposed on those who carry out this activity illegally will therefore be double what they have been up to now, to dissuade people and to protect and guarantee legal certainty for legitimate tourist accommodation.
In the words of the island's councillor for Tourism, José Marcial Rodríguez Díaz, "Illegal supply, regardless of the sector in which it operates, is very harmful unfair competition for the vast majority of those who do things correctly in Mallorca and represents a terrible problem for social harmony. It is something that the Consell wants to tackle and eradicate".
Furthermore, following the Decree of Administrative Simplification recently approved by the Government, the Department of Tourism of the Consell de Mallorca will from now on make it compulsory to cease the activity in all cases where penalties are initiated.
The sanctioned person's rights remain unchanged, and they will be able to dispute the proceedings, as has been the case until now. They will have seven days to dispute having to cease their activity, and the deadline for submitting disputes about the sanction will be 15 days, under the new decree approved by the Govern.
Lastly, if the disputes are not resolved within seven days, the Consell de Mallorca's Department of Tourism will refer these non-compliances to the Public Prosecutor's Office so that they can be dealt with accordingly.
